1. Welcome to Maktuba
These Terms of Service ("Terms") govern your access to and use of
the Maktuba mobile application ("Maktuba," "the App," "Service").
Maktuba is operated by:

**By downloading, installing, or using Maktuba, you agree to be
bound by these Terms. If you do not agree, do not use the App.**
2. What Maktuba Is
Maktuba is a mystical entertainment application that provides
AI-generated readings based on ancient traditions including:
• Tarot card reading
• Coffee cup (tasseography) reading
• Palm reading (palmistry)
• Numerology and Kabbalah
• Astrology (Western, Vedic, Chinese)
• Dream interpretation
• I-Ching and other traditions
The readings are generated by artificial intelligence (powered by
Anthropic's Claude models) trained on a curated library of over
46,000 books across 14 languages and 12 cultures.
**Maktuba is for entertainment and self-reflection purposes only.**
3. What Maktuba Is NOT — Critical Disclaimer
**Please read this section carefully. This is the most important
part of these Terms.**
Maktuba is:
• **NOT a fortune-telling service.** We do not predict the future.
The app uses AI to generate content based on ancient traditions.
No one at Maktuba possesses supernatural abilities.
• **NOT medical advice.** Maktuba is not a doctor, therapist, or
healthcare provider. Never use a Maktuba reading to diagnose,
treat, or make decisions about any medical condition. If you
need medical help, consult a licensed healthcare professional.
• **NOT mental health treatment.** If you are experiencing emotional
distress, anxiety, depression, or thoughts of self-harm, please
contact a mental health professional immediately. Emergency
resources are listed in Section 20.
• **NOT legal advice.** Readings should never be used as a basis
for legal decisions. Consult a qualified lawyer for legal matters.
• **NOT financial or investment advice.** Do not make investment,
business, or major financial decisions based on Maktuba readings.
Consult a licensed financial advisor.
• **NOT a substitute for human judgment.** Important life decisions
(marriage, divorce, career changes, medical treatment, financial
investments, etc.) should be made by you, based on your own
judgment and with input from qualified human professionals.
• **NOT a religion.** Maktuba is entertainment. It is not a spiritual
authority, religious institution, or faith-based practice.
**You acknowledge that you use Maktuba at your own risk, for
entertainment and self-reflection only.**
4. AI-Generated Content Disclosure
All readings, chat responses, and interpretations provided by
Maktuba are **generated by artificial intelligence** (Anthropic's
Claude models).
AI-generated content:
• May contain inaccuracies or errors
• Is probabilistic, not deterministic
• May produce different responses to similar inputs
• Does not reflect actual supernatural insight or prediction
• Is not reviewed or fact-checked by human experts before delivery
We make no warranty as to the accuracy, reliability, or suitability
of any reading for any purpose.
5. Eligibility
5.1 Age Requirement
You must be at least **18 years old** to use Maktuba. By using the
App, you represent and warrant that you are 18 or older.
We do not knowingly allow users under 18 to create accounts. If
you are under 18, you must not use the App. If we discover that
a user is under 18, we will terminate their access.
5.2 Legal Capacity
You must have the legal capacity to enter into a binding contract
under the laws of your jurisdiction.
5.3 Geographic Restrictions
Maktuba may not be available in all countries. We reserve the
right to restrict or refuse service in any jurisdiction.
6. Your Account
6.1 Anonymous Account Creation
Maktuba uses anonymous authentication. You do not need to provide
an email address, phone number, or other identifying information
to use the App.
You are asked to provide:
• Your first name (for personalization — stays on your device)
• Your date of birth (for astrological calculations — stays on your device)
• Optional: mother's name, birth time, birth place
This information is stored **only on your device**. It is not
transmitted to our servers. See our Privacy Policy for details.
6.2 Account Security
You are responsible for maintaining the security of your device.
If someone gains access to your device, they may access your
Maktuba data. We recommend using device-level protection
(Face ID, Touch ID, PIN).
6.3 Multiple Devices
Because data is stored locally, your profile and history do not
automatically sync across devices. Your purchased keys (via Apple
or Google) can be restored on a new device using the "Restore
Purchases" feature.
7. Keys — The In-App Currency
7.1 What Keys Are
"Keys" are the virtual in-app currency used to unlock readings and
features within Maktuba. Keys have no monetary value outside the
App and cannot be exchanged for cash or any other currency.
7.2 How to Get Keys
**Welcome Gift:** Every new user receives 10 keys upon completing
onboarding. This gift is one-time only.
**Purchase:** You can buy key packs through the App:

Prices in your local currency are displayed in the App and
determined by Apple or Google based on your App Store / Play
Store region.
7.3 No Subscriptions
**Maktuba does not offer subscriptions.** All key purchases are
one-time, consumable in-app purchases. You pay once, the keys
are yours.
7.4 Keys Never Expire
Keys you purchase never expire. They remain in your balance
until used.
7.5 Keys Are Non-Refundable Except as Required by Law
Once purchased, keys are generally non-refundable, except:
• As required by the Apple App Store or Google Play Store refund
policies (contact them directly for Apple/Google refunds)
• As required by applicable consumer protection law (see Section 8)
• In case of a technical failure attributable to us
7.6 No Transfer
Keys cannot be transferred between accounts, sold, gifted, or
exchanged.
7.7 Key Cost of Readings
Different readings cost different amounts of keys, ranging from
1 key (simple daily readings) to 200 keys (premium multi-system
reports). The cost is always clearly displayed before you confirm.
7.8 Loss of Keys
If you delete the App, your keys remain linked to your Apple ID
or Google account and can be restored. If you lose access to your
device and your Apple/Google account, we may not be able to
recover your keys. We recommend keeping your account credentials
secure.
8. Cooling-Off Period and Refunds
8.1 Statutory Cooling-Off Right
Under Gibraltar and EU consumer protection law, you generally have
a **14-day right of withdrawal** from distance contracts. However,
this right does not apply to digital content supplied immediately
after your explicit consent.
8.2 Immediate Delivery Waiver
When you purchase a key pack, you expressly consent to immediate
delivery of the digital content (the keys) and acknowledge that
you thereby waive your 14-day right of withdrawal for any keys
already credited to your account.
This consent is obtained at the point of purchase — not during
app onboarding.
8.3 Refunds
Refund requests are handled by the platform through which you
purchased:
• **iOS (App Store):** https://reportaproblem.apple.com/
• **Android (Play Store):** https://support.google.com/googleplay/answer/2479637
We can only process refunds that have been approved by Apple or
Google. Once approved, we will deduct the corresponding keys
from your balance.
8.4 Chargebacks
If you initiate a chargeback, we reserve the right to terminate
your account and revoke all keys, including those not originating
from the disputed transaction.
9. Prohibited Uses
You agree not to:
• Use Maktuba for any unlawful purpose
• Use Maktuba to provide readings or services to third parties
for commercial purposes
• Attempt to reverse-engineer, decompile, or extract the source
code of the App
• Attempt to access our servers, AI systems, or backend without
authorization
• Create automated scripts, bots, or scrapers that interact with
the App
• Upload content that is illegal, abusive, threatening, or
infringes third-party rights
• Upload images containing minors
• Impersonate another person in readings about relationships
• Resell, redistribute, or publicly share readings for commercial
gain
• Use Maktuba to harass, stalk, or harm another person
• Circumvent our payment systems or attempt to obtain keys
fraudulently
Violation may result in termination of your access and, where
applicable, legal action.
10. Your Content
10.1 What You Submit
When you use Maktuba, you may submit:
• Text (questions, dream descriptions, messages)
• Images (coffee cup photos, palm photos)
• Names and dates (yours or others')
This is your "User Content."
10.2 License to Use
By submitting User Content, you grant us a limited, worldwide,
royalty-free license to process that content solely to provide
the requested reading. This license:
• Is limited to the specific reading you requested
• Terminates as soon as the reading is generated
• Does **not** allow us to use your content for training AI,
marketing, or any other purpose
• Does **not** allow us to share your content with third parties
except as necessary for reading generation (Anthropic, under
Zero Data Retention)
10.3 Your Responsibility
You are solely responsible for your User Content. You represent that:
• You have the right to submit the content
• The content does not infringe any third party's rights
• Images do not contain minors
• Names and dates of other people are submitted with their
implicit or explicit permission (e.g., for compatibility readings)
10.4 Third-Party People
When you request readings about another person (e.g., compatibility
with a partner), you are responsible for any legal or ethical
considerations. We recommend not requesting readings about people
without their general awareness, particularly for sensitive
categories like mental health or past relationships.
11. Intellectual Property
11.1 Our Property
All rights, title, and interest in and to the App, including its
design, brand, name ("Maktuba"), character ("Maktuba" as
depicted), illustrations, code, content libraries, and all
related intellectual property, are owned by KBR Global Creative
Consulting Ltd.
You may not:
• Copy, modify, or distribute our content
• Use our branding or marks without written permission
• Create derivative works based on the App
11.2 Your Readings
Individual readings generated for you are provided for your
personal, non-commercial use. You may:
• Save them to your device
• Share them on social media for personal, non-commercial purposes
• Screenshot them for your own records
You may not:
• Compile or republish readings as your own work
• Use readings for commercial fortune-telling services
• Sell or redistribute readings
11.3 Feedback
If you provide feedback, suggestions, or ideas about the App, we
may use them without obligation or compensation to you.
12. Third-Party Services
Maktuba uses the following third-party services:
• **Anthropic** (Claude AI): Reading generation
• **Firebase / Google**: Authentication, analytics
• **Apple App Store / Google Play Store**: Distribution, payments
• **Expo / RevenueCat**: Technical infrastructure
Your use of these services through Maktuba is subject to their
respective terms and privacy policies.
13. Disclaimers
13.1 AS-IS Provision
MAKTUBA IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES
OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO
IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR
PURPOSE, NON-INFRINGEMENT, OR ACCURACY.
13.2 No Warranty of Accuracy
We make no warranty that readings will be accurate, reliable,
complete, useful, or appropriate for your circumstances.
13.3 No Warranty of Availability
We do not guarantee that the App will be uninterrupted, error-free,
or available at all times. We may suspend or modify the Service
at any time.
13.4 Your Reliance
You rely on readings at your own risk. We are not responsible for
decisions you make based on readings.
14. Limitation of Liability
14.1 Exclusion of Indirect Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KBR GLOBAL CREATIVE
CONSULTING LTD AND ITS DIRECTORS, EMPLOYEES, AND AGENTS SHALL
NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL,
CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO
LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES,
ARISING FROM YOUR USE OF THE APP OR RELIANCE ON READINGS.
14.2 Liability Cap
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR
RELATING TO THE APP SHALL NOT EXCEED THE GREATER OF:
(a) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM; OR
(b) USD $50.
14.3 No Liability for Third Parties
We are not liable for actions or omissions of third parties,
including Apple, Google, Anthropic, or any individual with whom
you share readings.
14.4 Consumer Rights Preserved
Nothing in these Terms limits or excludes our liability for:
• Death or personal injury caused by our negligence
• Fraud or fraudulent misrepresentation
• Any liability that cannot be limited or excluded by applicable law
Where you are a "consumer" under local law, your statutory rights
are unaffected.
15. Indemnification
You agree to indemnify, defend, and hold harmless KBR Global
Creative Consulting Ltd from any claims, losses, damages, and
expenses (including reasonable legal fees) arising from:
• Your violation of these Terms
• Your misuse of the App
• Your User Content
• Your infringement of any third-party right
16. Termination
16.1 Termination by You
You may stop using Maktuba at any time by deleting the App.
16.2 Termination by Us
We may suspend or terminate your access immediately, without
notice, if:
• You violate these Terms
• You engage in fraud or illegal activity
• We are required to do so by law
• We discontinue the App
Upon termination:
• Your right to use the App ends
• Your purchased keys may be forfeited (if you violated these Terms)
• Your device data remains yours (we don't have it)
16.3 Survival
Sections that by their nature should survive termination
(including intellectual property, disclaimers, limitation of
liability, indemnification, and governing law) shall survive.
17. Governing Law and Jurisdiction
17.1 Governing Law
These Terms are governed by the laws of **Gibraltar**, without
regard to conflict of law principles.
17.2 Jurisdiction
Any dispute shall be brought before the competent courts of
Gibraltar, except where local consumer protection law permits
you to bring a claim in your country of residence.
17.3 Consumer Protections
If you are a consumer resident in the European Union, United
Kingdom, or Israel, you retain the benefit of any mandatory
consumer protection laws of your country of residence.
18. Dispute Resolution
18.1 Informal Resolution
Before filing any formal claim, please contact us at
privacy@maktuba.app. We will attempt to resolve disputes
informally within 30 days.
18.2 EU Online Dispute Resolution
EU consumers may use the European Commission's Online Dispute
Resolution platform: https://ec.europa.eu/consumers/odr
18.3 Class Action Waiver
To the extent permitted by law, you agree to bring any claim
individually and waive the right to bring claims as part of a
class action or collective proceeding.
19. General Provisions
19.1 Entire Agreement
These Terms, together with the Privacy Policy, constitute the
entire agreement between you and us regarding Maktuba.
19.2 Severability
If any provision is found unenforceable, the remaining provisions
shall continue in full force and effect.
19.3 No Waiver
Our failure to enforce any provision is not a waiver of that
provision.
19.4 Assignment
You may not assign these Terms without our prior written consent.
We may assign these Terms in connection with a merger, acquisition,
or sale of assets.
19.5 Changes to Terms
We may modify these Terms at any time. If we make material
changes, we will notify you via the App and update the "Last
Updated" date. Continued use after changes constitutes acceptance.
19.6 Language
These Terms are written in English. Translations, if provided,
are for convenience only. In case of conflict, the English
version prevails.
19.7 Force Majeure
We are not liable for failures due to events beyond our reasonable
control (natural disasters, war, pandemics, government actions,
internet outages, etc.).
